General Booking and Terms (GBT)

§ 1 · Contracting party

Italian law applies exclusively. In case of conflicting language versions, the Italian text prevails.

§ 2 · Scope

These General Booking and Terms apply to all bookings of holiday houses and purchases of products (olive oil, wine, vouchers) made via our website, by e-mail, or by telephone. By completing a booking the guest accepts these terms in full.

§ 3 · Booking and contract formation

Bookings may be made via the website, by e-mail, or by telephone.
The contract is formed upon our written booking confirmation by e-mail.
A payment receipt for the deposit (30% of the total price) is issued simultaneously.
Availability information is non-binding until written confirmation is issued.
Contract languages are German, English, and Italian. In case of contradiction, the Italian text prevails.

§ 4 · Payment

Deposit: 30% of the total price, due within 7 days of booking confirmation. The deposit serves as an advance payment on the total price.
The remaining amount is due no later than 14 days before the start of the stay, unless payment on site upon arrival has been agreed.
Payment methods: SEPA bank transfer, credit card (Visa, MasterCard).
The balance may additionally or alternatively be settled on site at arrival by cash or card payment.
If the deposit is not received on time, Podere Acquarello may cancel the booking.
All prices include applicable VAT unless stated otherwise.

§ 5 · Security deposit

For longer stays (14 nights or more), group bookings, or bookings with pets, Podere Acquarello may request a refundable security deposit of up to € 300.00.

This is fully refunded within 7 days of check-out, provided the accommodation is returned in good condition. In the event of damage, the deposit may be applied towards proven repair or cleaning costs.

§ 6 · Cancellation by the guest

The decisive date is the time of receipt of the written cancellation by e-mail at info@podere-acquarello.com:

Cancellation fees represent liquidated damages. Italian law applies. We strongly recommend travel cancellation insurance.

Rebooking is permitted once, free of charge, up to 30 days before arrival, subject to availability.
Any price difference resulting from the rebooking is borne by the guest.
Later rebookings are treated as cancellations.
No partial refund is granted for early departure.
Cancellations must be submitted in writing by e-mail and take effect only upon our written confirmation.
Refunds are processed to the original payment method within 14 banking days.

§ 7 · Cancellation by the provider

In the event of unforeseeable inability to provide the service (including force majeure, official orders, natural disasters, wildfires, pandemics, power or water outages, or unforeseen property damage), Podere Acquarello will notify the guest without delay.

In such cases, Podere Acquarello will preferably offer a free rebooking or a time-unlimited voucher in the amount already paid.

A cash refund will only be made where mandatory legal provisions require it.

Further claims, in particular claims for damages, are excluded to the extent permitted by law and provided there is no intentional or grossly negligent conduct by Podere Acquarello.

§ 8 · Force majeure

In the event of proven force majeure directly affecting the place of stay or the guest’s place of residence (including officially ordered travel restrictions, natural disasters, pandemics, or comparable extraordinary circumstances), Podere Acquarello will preferably offer a free rebooking or a time-unlimited voucher.

A cash refund will only be made where mandatory legal provisions require it.

Further claims do not exist.

§ 9 · Arrival and departure

Check-in: 3:00 pm–8:00 pm. Late arrivals must be announced at least 24 hours in advance by e-mail.
Check-out: no later than 10:00 am on the day of departure.
Early check-in / late check-out: subject to availability, surcharge € 20.00.
Failure to arrive without prior notice by 8:00 pm = no-show; no refund.
Minimum stay requirements may apply depending on season and property; these are shown at the time of booking.

§ 10 · Tourist tax (Imposta di Soggiorno)

Current rate: € 2.00 per person per night as set by the Municipality of Massa Marittima.
Not included in the booking price – payable on site at arrival by cash or card.
Children under 14 years of age are exempt.
Podere Acquarello collects the tourist tax as a pass-through on behalf of the Municipality; it does not constitute remuneration for our services.

§ 11 · House rules

Smoking is prohibited in all indoor areas. Designated outdoor areas are available.
Pets: upon request, at no extra charge. Pets must never be left unattended, whether on the property grounds or inside the accommodation.
Quiet hours: 10:00 pm–8:00 am.
Serious misconduct entitling Podere Acquarello to terminate the stay immediately without refund includes in particular: noise disturbance, unauthorised events, aggressive behaviour towards guests or staff, excessive fouling, and violations of applicable law.
In the event of exceptional soiling of the accommodation or furnishings, Podere Acquarello reserves the right to charge additional cleaning costs.
Guests are liable for all damage caused by themselves or their party to the property of Podere Acquarello.
Garden, agricultural, and maintenance work on the property forms part of normal operations and does not entitle guests to a price reduction.

§ 12 · Registration obligation (Questura)

Pursuant to Art. 109 TULPS and Legislative Decree 286/98, we are legally required to record the personal details of all guests upon arrival and report them via the Alloggiati Web portal to the Questura. Each guest must present a valid photo ID at check-in.

§ 13 · Liability

Podere Acquarello is not liable for loss, theft, or damage to guests’ belongings to the extent permitted by law. Use of paths and communal areas is at the guest’s own risk. Liability for gross negligence or breach of material obligations remains unaffected.

§ 14 · No right of withdrawal for accommodation bookings

Pursuant to Art. 59(l) of Legislative Decree 206/2005 (Codice del Consumo), no statutory right of withdrawal exists for accommodation contracts with a specific stay period. Only the cancellation rules set out in these terms apply.

§ 15 · Right of withdrawal for goods purchases (online shop)

For distance contracts for the purchase of goods, consumers have a statutory right of withdrawal.

Withdrawal notice

You have the right to withdraw from this contract within 14 days without giving any reason. The period begins on the day you, or a third party you designate other than the carrier, take physical possession of the goods.

Withdrawal may be exercised by unambiguous declaration by e-mail to info@podere-acquarello.com or by post to: Podere Acquarello, Loc. Acquarello n° 26, I-58024 Massa Marittima (GR), Italy.

We will reimburse all payments received, including delivery costs except additional costs from a chosen non-standard delivery, without delay and within 14 days of receipt of the withdrawal notice, using the same payment method. Return costs are borne by the buyer.

Exceptions to the right of withdrawal:

Goods liable to deteriorate or expire rapidly.
Sealed goods not suitable for return for health or hygiene reasons if the seal has been removed after delivery, e.g. opened wine bottles.
Goods made to the consumer’s specifications.

§ 16 · Online shop – sale of goods

Delivery area and times

Delivery area: Germany, Italy, and selected EU countries, as shown during checkout.
Delivery times are non-binding estimates: approx. 3–7 working days after receipt of payment for Germany; longer for other EU destinations.
Delays attributable to the shipping provider are outside our control.
Partial deliveries are permitted and do not entitle the buyer to withhold payment or claim a price reduction.

Shipping costs

Current shipping costs are clearly displayed during checkout before the order is completed.

Retention of title

Delivered goods remain the property of Podere Acquarello until full payment is received.

Alcoholic products

Wine and alcoholic beverages may not be sold to persons under the age of 18. By placing an order, the buyer confirms being at least 18 years of age. Alcoholic products are shipped in household quantities only. We reserve the right to arrange age verification by the delivery person.

§ 17 · Minors

Contracts may only be concluded with persons aged 18 or over. Minors may not act as principal tenants. Written parental consent is required for minors travelling without a guardian.

§ 18 · Data protection and communications

Personal data is processed in accordance with our Privacy Policy and the requirements of the GDPR and Legislative Decree 196/2003 as amended, available at www.podere-acquarello.com/datenschutz/.

Please note that e-mail communication may be subject to security vulnerabilities and does not guarantee fully secure transmission.

For photographs and videos taken on the property for our own marketing communications, such as social media or website use, we obtain the consent of the persons depicted.

§ 19 · Governing law and jurisdiction

Italian law applies exclusively. For consumers, mandatory jurisdiction lies at the consumer’s place of residence pursuant to Art. 66-bis of Legislative Decree 206/2005. For business customers, exclusive jurisdiction is agreed at Massa Marittima (GR).
